Auction Location:  Ramada Inn of Batesville, north of Batesville, Ar at 12:03 pm-CST

The heirs of the late Ruby Swaims have ordered the sale of this incredible 38.1+/- ac. property, located just 8.2 miles from the Batesiville City Limits and a short distance from Pleasant Plains.  Attributes of the offering following:

Tract 1–Appx 9.6 acres with appx 322 feet of frontage on Hwy 167

Tract 2–Appx.9.2 acres with appx 322 feet of frontage on Hwy 167

Tract 3–Appx 9.9 acres with appx 322 feet of frontage on Hwy 167

Tract 4–Appx 9.4 acres with appx 322 feet of frontage on Hwy 167

Minerals owned by owners will be offered as a separate item.  A mineral search is being performed and will be made available to interested parties on this web site and on day of auction.

Auctioneer reserves the right to group and re-group land tracts and minerals in such a way that will maximize the total price for the sellers.

Nominal Opening bid for land is $1000 per acres.  All property and related minerals are selling subject to SELLER CONFIRMATION on day of sale.

PRE-AUCTION OFFERS WILL BE ACCEPTED AND WILL BE PRESENTED.

A perimeter survey is provided under “documents.”  If land tracts sell to mulitple buyers, said buyers shall share pro-ratably in the cost establishing the interior lines.

Terms and Conditions

REGRISTRATION

In order to receive a bidder’s number, you must register by presenting a driver’s license and guaranteed funds (cashier’s check) in the amount of $2500 made payable to yourself. 

 

DAY OF AUCTION DEPOSIT

If you are the successful bidder, you will endorse the cashier’s check over to the auction company as part of your day of auction deposit of 10% of your bid.  The balance of your deposit may be paid with a personal or company check accompanied by a bank letter of guarantee or Certified Funds.

 

CONTRACT OF PURCHASE

The successful bidder must sign a real estate purchase contract immediately upon the conclusion of the bidding.  No contract will be contingent on any matter such as financing.

 

BUYER’S PREMIUM

A Buyer’s Premium of ten percent (10%) will be added to the successful bidder’s high bid to determine the Total Purchase Price.

 

CLOSING

Closing shall take place no later than thirty (30) days after the auction at the offices of Independence County Abstract, 150 South Broad Street, Batesville, Ar 72501, Phone number 870-793-3333.  The entire Purchase Price less the day of auction deposit must be paid by cashier’s check other certified funds.  Buyer’s day of auction deposit in non-refundable. 

 

 

SELLER’S WARRANTY

The only warranty by the seller is good, merchantable title.  The property is selling “as is, where is.”  Title Insurance is available at buyer’s expense.  The cost of providing good title such as title searches will be borne by the seller.  Real Estate Taxes will be pro-rated and all other closing costs will be split evenly between the buyer and the seller.

RPM-Mitchum Auctions, LLC and Josh Taylor–Coldwell Banker/RPM represent the sellers exclusively and act solely on their behalf. 

 

SURVEY

A perimeter survey is provided under “documents.”  If land tracts sell to mulitple buyers, said buyers shall share pro-ratably in the cost establishing the interior lines.  An estimate of these costs will be available on or before auction day.
