Real Estate Terms & Conditions:
All bidders must register acknowledging that they have read and agree to the “Terms and Conditions” of the sale as outlined prior to bidding.
Announcements: All announcements made the day of auction take precedence over any and all previously written advertisements or any prior written or verbal terms of sale. Auctioneer/Seller reserves the right to withdraw property from auction at any time.
Agency: The Ligon Company, auctioneers, firm, broker and all parties employed by or associated with, will be acting solely as a representative of the Seller.
Auctioneer Rights: All decisions of the Auctioneer are final. The Auctioneer reserves the right to reject any bid or bidder and has the right to accept back-up contracts the day of sale. In case of a tie or disputed bid, the Auctioneer reserves the right to re-open the bidding to determine the highest bid and settle the disputed bid. This is at the sole discretion of the Auctioneer.
Earnest Money Deposit: A deposit equal to 10% of the Total Purchase Price is required immediately after the auction. No credit cards will be accepted. The remaining balance of the Total Purchase Price is due within THIRTY (30) days from the date of the offer’s commencement date. Deposit funds are non-refundable. If paying with a certified or cashier check, the check(s) should be made payable to yourself, and in the event you are the Winning Bidder you will endorse it to: .
Purchase Price:A 10% Buyer’s Premium will be added to the high bid at the auction and become the Total Purchase Price. The 10% Buyer’s Premium must be paid at the settlement by the high bidder in addition to all other applicable fees and charges described herein and in the Auction Purchase and Sale Agreement.
Buyer Registration: This Auction will be held on-site at the property. All bidders must register (at the designated area) by providing appropriate government ID and receive a bidder number. By registering and accepting a number, all bidders agree to abide by all of the Terms of Sale.
Broker Registration: Brokers/Agents must register their client by 5:00pm the business day before the auction via the Broker Registration Form. A three percent (3%) commission of the high bid price will be paid to any properly registered broker whose client purchases real estate at the auction and closes in full. It is the responsibility of any agent representing a client to have completed and returned the Broker Registration Form by the published deadline. No registration forms will be accepted at auction.
Bidding Process: The property may be offered in one or more lots. No bid may be withdrawn by a bidder once made to the Auctioneer. All bids are an irrevocable offer to buy and shall remain valid and enforceable to until the Auctioneer declares the property “Sold” and the auction has concluded. The Auctioneer reserves the right, but has no obligation, to bid on behalf of the Seller up to the undisclosed reserve price, unless the property is declared “Absolute” or the “Reserve has been met”. The bidder’s number is nontransferable. The Seller has seven (7) days to accept or reject the high bid.
All Sales are Final: By registering and bidding, the buyer acknowledges they understand and agree to the Terms of Sale. The Buyer acknowledges that they have read the Auction Purchase and Sale Agreement and the Terms and Conditions of the Auction Sale provided by Auctioneer and accept the Auction Purchase and Sale Agreement without any changes to the pre-printed text. The buyer must sign all contract documents immediately after the auction.
Representation: Although information has been obtained from sources deemed reliable, the Auctioneers, The Ligon Company, its representatives, employees, firm, broker, their attorney’s nor the Seller make any guarantee or warranty of any kind expressed or implied as to the accuracy of the information herein contained.
Real Property: The real property, offered for sale at the Auction are being sold “AS IS”, “WHERE IS”, WITH ALL FAULTS AND DEFECTS”, without warranty or guarantee of any kind, except as expressly provided for in the Auction Purchase and Sale Agreement and Terms and Conditions of the Auction Sale. Each potential Buyer is encouraged to perform his/her own independent inspections, inquiries and due diligence concerning the described property. The information is being furnished to bidders for the bidder’s convenience and it is the responsibility of the bidder to determine that information contained herein is accurate and complete. Any reliance on the contents shall be solely at the recipient’s risk. It is the Buyer’s responsibility to inspect the property prior to bidding to make their determination as to the condition or seek professional inspection (at the Buyer’s expense) of the property. Buyer(s) agrees to accept property with its current zoning, easements, and any and all right-of-ways that carry with it. All information is taken from sources deemed to be accurate and reliable, all measurements are approximate and not to scale. The Seller and the Auctioneers, The Ligon Company, contractors, employees, firm, or brokers assume no liability in this matter. Any and all announcements made the day of auction take precedence over any and all previously written advertisements or any prior written or verbal terms of sale but shall in no event form the basis of any representation or warranty by Seller or Auctioneers. By bidding on the property, you are accepting all terms and conditions stated herein.
Financing: The purchase is not contingent on obtaining financing or qualification.
Buyer Default: In the event a high bid is accepted and the Buyer fails to close or comply with the terms of the Auction Purchase and Sale Agreement, then the earnest money will be forfeited as liquidated damages, but such forfeiture shall not affect any other remedies available to Seller for such failure.
Indemnity: The Buyer assumes full responsibility and liability for any claim or actions based on or arising out of injuries, death, damage, loss of property, sustained or alleged to have been sustained by Buyer, its agent, principals, associates, friends, family and/or employees, in connection with or to have arisen out of or incidental to the auction including but not limited to the performance of this contract. Regardless of whether such claims or actions are founded whole or in part upon alleged negligence or negligent misrepresentation of Seller, Auctioneer, or the employees, agents, invitees, or licensees thereof, Buyer agrees to indemnify and hold harmless Seller, Auctioneer, and their representatives, and the employees, agents, invitees and licensees thereof in respect of any such matters and agrees to defend any claim or suit or action brought against Seller, Auctioneer, and their representatives, and the employees, agents, invitees and licensees thereof.
Environmental Disclaimer: The Seller and The Ligon Company, agents, contractors and employees do not warrant or covenant with Buyer(s) with respect to the existence or nonexistence of any pollutants, contaminants, mold, or hazardous waste prohibited by federal, state or local law or claims based thereon arising out of the actual or threatened discharge, release, disposal, seepage, migration or escape of such substances at, from or into the demised premises. Buyer is to rely upon their own environmental audit or examination of the premises.
Acreage and Square Feet: All acreages and square feet descriptions are approximate. If there is a discrepancy between The Ligon Company or its representative and the actual acreage and/or square feet as determined by a surveyor or appraiser, the price will not be adjusted. The statements, while not guaranteed, are from reliable sources. Any costs incurred in establishing boundaries shall be the responsibility of the buyer(s). Each sale is subject to easements, right-of-way, reservation and/or restrictions of record.
Closing: Time is of the Essence. The balance of the purchase price will be due in THIRTY (30) days from the Commencement Date, which is the date of mutual execution of the Contract of Purchase and Sale by the Seller and Buyer. The Seller at closing will convey the real estate with a Deed. Buyer is responsible for all customary closing costs associated with closing to include but not limited to all transfer and recordation closing fees, financing expenses, title fees, title insurance, survey, easement and appraisal. Taxes will be prorated from date of closing.

Bidding Style is Staggered: Each lot will close 15 Seconds after the first lot in the auction consecutively. Lots will begin closing at 7 PM and continue until the final lot has closed.
& Soft Close: If a bid is placed on a lot during the last minute of bidding, the time will be extended by one minute each time.
**** If you are bidding at the close of the Auction, please make sure to select “LIVE CATALOG VIEW” to view the auction in real time. If you do not view the “LIVE CATALOG” at the conclusion of the Auction, you may need to manually refresh your computer screen. We recommend being signed into the Auction at least 15 minutes prior to closing, if you wish to bid during auction closing.

Terms of the Auction: 15% Buyer’s Premium for The Ligon Company Online Bids. (Online Absentee & Internet Bidders must register with Amex, Discover, Visa or MasterCard) Information is subject to change. All lots are sold as is, where is, with all faults, imperfections and errors of description. Due diligence is the responsibility of the bidder/buyer. All sales are final. No credit card charge backs will be allowed. Purchases may be removed upon receipt of payment in full. Buyers assume complete responsibility for care of each purchase at time of sale. We reserve the right to refuse service to anyone. All statements made prior to the sale of any item take precedence over written material and any prior verbal statements. The auction company is not responsible for accidents, thefts, errors or omissions.
Catalog: The Ligon Company has put forth every effort in preparing the catalog for this auction to provide accurate descriptions of all items. All property is sold ‘as-is’ and it is the bidder’s responsibility to determine the exact condition of each item. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. ALL MEASUREMENTS, DESCRIPTIONS AND QUANTITIES ARE APPROXIMATE AND MADE TO THE BEST OF OUR KNOWLEDGE.
All sales are final.
There will be a 15% Buyers Premium added to the high bid to determine the selling price. Sales tax of 7% will be added to the selling price. Dealers and retailers must fill out the exemption forms in full before the close of auction.
Payments: All accounts must be settled at the conclusion of the auction. We accept Amex, Discover, Visa & MasterCard. You have the option to pay cash or check at pick up, if preferred. If you have not picked up within 1 hour prior to close of pick up, your credit card will be charged for your purchases, plus buyer’s premiums, and any taxes. A pre-auction authorization will be performed to establish available credit. Debit cards may show a hold on funds for a short period of time. NOTHING will be charged to your card until a purchase is made. Each transaction necessary to collect insufficient funds will have a $25 fee imposed. Note: Checks may be processed the day of the auction; be sure to have adequate funds in your account.
Exemptions: To receive exemption, dealers and retailers must have filled out and submitted the exemption forms before the close of auction. Exemption forms can be emailed to firstname.lastname@example.org.
Unpaid Balances: The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. The purchaser also agrees that a fee of 2% per month be added to the balance of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser’s failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in York County, SC.
Removal: All items must be removed the day following the close of the Auction during specified times. The designated pick up time will be posted under “Dates” on our website. If you are unable to pick up during this time, please make arrangements at least 1 day prior to the close of auction.
Unless prior arrangements are made before the close of the auction, you will be charged a $25 fee to schedule an alternate pick up time. It is your responsibility to contact our office to make these arrangements.
It is the buyer’s responsibility to provide adequate equipment, packing materials and manpower to remove his or her items. If assistance is required, a fee may be incurred payable to The Ligon Company. Items that have not been picked up within 5 Business Days following Auction will be considered abandoned, and no refunds will be given.
Pickups: All items MUST be picked up during specified pick up times. It is the buyer’s responsibility to check all contents of the package before removing it from the premises. If you pick up at an auction location or by another arrangement it is also your responsibility to check the contents of the package in the company of a Ligon Company Employee. We will not be held responsible for damaged or missing pieces once the package is in possession of the bidder. It’s your responsibility to review your purchases and their condition.
Shipping: The Ligon Company, through the United States Postal Service or United Parcel Service, can arrange packing and shipping at the buyer’s expense in addition to a $10.00 handling fee. Additional fees may apply to large or heavy items. Packing and shipping costs are the responsibility of the buyer and may be quoted before shipping. All items will be insured for the purchase price. Please contact the auction company prior to purchase for general shipping and handling information. Our first priority is to deliver your new purchase in excellent condition.
Missing Items: We document the contents of each package. If we have missed an item in your shipment our documentation will show that. Please notify us within 2 business days of receiving the package if you think something is not included. If our documentation shows it was not packed we will forward it immediately at our cost. We are not responsible for boxes opened by anyone other than the owner. Please check the entire box and packaging for contents. DO NOT discard the original shipping box and packaging if you think something is missing or damaged.
Storage: If you have a large amount of items, other charges may apply. In addition to the storage fee, the buyer is still responsible for paying labor costs to prepare your items for pickup.

If there is a platform outage during the close of an Auction, we reserve the right to no-sell the items affected during outage and offer for resale at a later date.
